Key cases/experience – representative matters

Fraudulent payments were made into an account controlled by a third party. Urgent freezing orders were obtained against the bank, allowing the client to recover the funds transferred to the account.

A security provider challenged mortgages exceeding $100 million, alleging the documents were fraudulent and denying knowledge of the transactions. The Court upheld the mortgages, with the subsequent appeal dismissed.

Two mortgagees disputed whether a first-ranking lender’s priority extended to costs incurred after exercising step-in rights. Following an unsuccessful first-instance decision, the Queensland Court of Appeal upheld the lender’s priority claim.

Mortgagors challenged enforcement proceedings concerning two secured properties. The lender obtained possession orders after critical evidence weakened the mortgagors’ position at trial.

When a Conflict Isn’t Enough: Refinancing, Borrower Vulnerability and the Limits of Unconscionability
In CPF Group v Everest Index International, the Supreme Court of New South Wales said no. Despite an admitted conflict of interest, the Court upheld a refinancing transaction, rejected claims of unconscionable conduct, and awarded possession in favour of the lender. For lenders, the decision reinforces the importance of a transaction’s purpose, documenting it adequately, and identifying a commercial benefit when putting refinance transactions together.
