A More Crowded Private Credit Market
Private credit is no longer a narrow alternative to bank lending. The market now spans institutional non-bank lenders, established private credit firms and newer entrants competing for transactions across property and commercial finance.
For Russell, that growth has created both opportunity and pressure. He sees a more crowded market, greater regulatory scrutiny and increased variation in lender experience and standards.
“Private credit has grown significantly and the market is much more crowded than it was seven years ago,” Russell said. “While this growth has been quick, it has also relied on years of property value growth.
“If values soften, some lenders may find that interest is not the only amount at risk. Capital can also become exposed.”
Taking a measured view, strong lenders will continue to operate effectively, but the market may place greater weight on disciplined due diligence, sound security structures and early action when borrower performance deteriorates.
Greater regulatory attention is adding another layer of pressure. Russell expects closer examination of transaction purpose, borrower circumstances, asset-based lending and structures that may engage consumer credit-type protections.
Beyond the Isolated Loan
Russell began in debt recovery before acting for insurers and eventually into banking and finance. His experience now spans securities enforcement, litigation funding, insolvency, shareholder matters, credit licensing and financial services compliance, including previously sitting on credit and litigation assessment boards.
That breadth allows Russell to look beyond the immediate loan or default. “A recovery strategy may also require consideration of corporate control, shareholder arrangements, regulatory exposure, competing stakeholders and the commercial viability of alternative pathways,” he said.
Russell previously worked at Summer Lawyers before leaving to lead a substantial banking and finance team serving a broad domestic and international commercial client base including that carriage of a complex dispute involving cross-border litigation and the recovery of $100M+ worth of securities. More recently, he worked at Finance Law. Those roles expanded his exposure to team leadership, complex finance and the wider corporate issues that can sit behind a lending dispute.
This perspective aligns closely with Summer Lawyers’ recovery-informed practice. His experience in enforcement informs how he assesses documentation, fraud controls, authority, verification and the decisions lenders make before a matter becomes contested.
Commercial Cost of Delay
Russell’s advice to lenders is direct: delay should be a deliberate commercial decision, not the default response. Accruing interest, changing property values, court timetables and seasonal sale conditions can quickly narrow the available recovery options.
“The short answer is not to wait without a clear reason,” he said. “Assess the position early, understand the available remedies and act before the timetable starts controlling the lender.”
Russell returns to Summer Lawyers with a deep understanding of mortgage law, broader finance experience and a record of leading substantial banking and finance teams.
“I know the firm’s lender focus and its decisiveness,” Russell said. “I am returning with a wider view of the market and the experience of leading teams elsewhere. The opportunity is to bring those perspectives together.”
