With nearly ten years’ experience across mortgage lending, commercial transactions and recovery, Elisabeth advises private and non-bank lenders throughout Australia and New Zealand.

Leadership experience across Advances and Recovery teams gives Elisabeth an informed understanding of transaction structure, security and enforcement. She advises lenders on complex financing arrangements and the disputes that follow when documentation, priority or recovery rights are tested.

This combination gives Elisabeth a clear understanding of how lending structures operate from origination through to enforcement. She applies that recovery experience when documenting transactions, identifying risks early and strengthening the lender’s position before funds are advanced.

Elisabeth is recognised for her technical rigour, controlled execution and commercially grounded judgment. She moves complex transactions efficiently towards settlement and, following default, develops clear enforcement strategies focused on the lender’s security position and recovery options.

When a Conflict Isn’t Enough: Refinancing, Borrower Vulnerability and the Limits of Unconscionability
In CPF Group v Everest Index International, the Supreme Court of New South Wales said no. Despite an admitted conflict of interest, the Court upheld a refinancing transaction, rejected claims of unconscionable conduct, and awarded possession in favour of the lender. For lenders, the decision reinforces the importance of a transaction’s purpose, documenting it adequately, and identifying a commercial benefit when putting refinance transactions together.
